This document is a public offer (hereinafter - "Terms") and defines the terms of use of the software and online services of BUDGETER AI (hereinafter - "Service"). The Terms are addressed to capable persons using the Service for personal or business purposes and govern the relationship between the Service owner and the user. Before using the Service, please read the Terms carefully. If you do not agree with the terms, do not use the Service.
1. Parties and Details

2. Terms and Definitions
The following terms are used in the Terms:
- "Service" - the BUDGETER AI application/web service, including the website, mobile applications, API and related features.
- "Account" - the User's account in the Service.
- "User Content" - data that the User enters, uploads or stores in the Service (transactions, categories, budgets, import files, etc.).
- "Subscription" - paid access to Service functionality under the terms of the selected plan.
- "Providers" - third parties providing infrastructure, payments, analytics, AI components and other services for the Service.
Other terms are interpreted in their usual meaning. In case of discrepancy between the Russian-language and other versions, the Russian-language version takes precedence, unless otherwise stated.
3. Acceptance of Terms and Contract Formation
- The contract between the User and the Provider is considered concluded from the moment when the User: clicks the "Create Account", "Register", "Pay" or similar button confirming consent; and/or actually starts using the Service (including installing the application, logging into the Account, creating records).
- If you use the Service on behalf of an organization, you confirm that you have the authority to accept the Terms on behalf of that organization, and the words "you/User" mean such organization and its authorized users.
- The Provider has the right to update the Terms. The current version is published at: [[URL Terms]]. By continuing to use the Service after the publication of a new version, the User agrees to the changes.
4. Registration, Account and Security
- Registration is required to access some features. The User undertakes to provide accurate data during registration and keep it up to date.
- The User is responsible for the security of credentials (login/password/access codes) and for all actions performed under their Account.
- It is prohibited to transfer access to the Account to third parties, unless this is expressly provided for by the functionality (for example, "family account" or team access).
- If the Account is suspected to be compromised, the User must immediately notify the Provider: [[security@yourdomain.com]].
5. Service Description
- BUDGETER AI provides tools for accounting income and expenses, categorization, budgeting, savings, data export/import and viewing analytics.
- The Service may include AI assistant features for analyzing User-entered data and generating text recommendations/reports.
- The Provider has the right to change functionality, add or disable individual features, release updates and fixes, provided that the basic availability of the Service is maintained within the selected plan (if applicable).
6. Subscriptions, Plans, Payment and Taxes
- Access to some features may be provided on a paid basis. Current plans are published in the Service interface or on the website: [[URL Pricing]].
- Example plan (if available): annual subscription - [[12 USD/year]] (or equivalent in local currency).
- Payment may be processed through third-party payment providers (e.g., App Store/Google Play/Stripe/others). In such cases, the rules of the respective provider apply, including billing and refund procedures.
- If applicable, taxes (VAT, etc.) may be included in the price or added to it depending on your jurisdiction and status. The final price is displayed before payment.
- Auto-renewal: if the Subscription provides for auto-renewal, it is carried out under the terms specified in the payment interface. The User can cancel auto-renewal through account settings/app store/payment provider settings.
- Non-payment/cancellation of payment may result in restriction of access to paid features or suspension of the Subscription.
7. Refunds and Subscription Cancellation
- Refund policy depends on the payment method:
- If payment is made through App Store/Google Play, refunds and cancellations are governed by the rules of the respective store.
- If payment is made directly to the Provider/through a payment provider, the refund conditions specified in the payment interface or in a separate policy apply: [[URL Refund Policy]].
- If legislation on distance selling/digital content applies, the User may have the right to cancel within the established period. In some cases, when digital service provision begins immediately, such right may be limited - the rules of your jurisdiction apply.

8. AI Functions: Terms, Limitations and Disclaimer
- The AI assistant is intended for informational purposes: improving the convenience of data analysis, generating reports, tips and recommendations. It is not a professional financial, investment, legal or tax advisor.
- AI results may contain errors, incompleteness or inaccuracies. The User is obliged to independently verify important information and make decisions at their own risk.
- The User controls what data to send in AI requests (for example, selection of period, categories, text comments).
- The Provider has the right to implement restrictions on AI use (request limits, fair use, abuse protection) for stable operation of the Service.
9. User Content and Processing License
- Rights to User Content remain with the User. The Provider does not claim ownership of your financial records.
- To provide the Service, the User grants the Provider a limited, non-exclusive, royalty-free, worldwide license to store, copy, transmit, process and display User Content to the extent necessary for the Service to operate (including backup and synchronization).
- The User guarantees that they have the rights to upload/process Content and that the Content does not violate the law and the rights of third parties.
- The Provider has the right to process aggregated and anonymized data about Service usage to improve the product, analytics and security (without disclosing personal data).
10. Acceptable Use Policy (AUP)
The User undertakes to use the Service lawfully and in good faith.
Prohibited:
- using the Service for illegal activities, including fraud, money laundering, violation of third-party rights;
- attempting to gain unauthorized access to the Service, accounts, data, API;
- circumventing restrictions, limits, security mechanisms, carrying out load attacks;
- embedding malicious code, viruses, using the Service for spam distribution;
- reverse engineering, decompilation or attempts to extract source code, except when expressly permitted by law;
- selling/reselling access to the Service or providing it to third parties as a standalone service without written permission from the Provider.
In case of violation of the rules, the Provider has the right to restrict or terminate access to the Service and/or delete prohibited content within the limits permitted by law.
11. Intellectual Property
- The Service, including software code, interfaces, design, logos and materials, is the intellectual property of the Provider and/or its licensors.
- The User is granted a limited, non-exclusive, non-transferable license to use the Service in accordance with the Terms for the duration of the contract.
- Any copying, modification, distribution or creation of derivative works without permission is prohibited, except in cases expressly permitted by law.
12. Feedback
- If you provide suggestions, feedback or ideas (hereinafter - "Feedback"), you permit the Provider to use it without restrictions to improve the Service, without payment of remuneration.
- The Provider is not obliged to implement Feedback and does not guarantee that suggestions will be used.
13. Third-Party Services and Integrations
- The Service may interact with third-party services (payments, analytics, cloud infrastructure, AI components, integrations).
- The Provider is not responsible for the operation and terms of third parties. The use of such services may be governed by their own terms and policies.
- If you import data from third-party sources or connect integrations, you are responsible for the legality of such connection and data processing.
14. Personal Data and Privacy
- Personal data processing is carried out in accordance with the BUDGETER AI Privacy Policy: [[URL Privacy Policy]].
- The use of cookies and similar technologies is described in the Cookie Policy: [[URL Cookie Policy]].
- If the User uses the Service on behalf of an organization and uploads personal data of third parties (for example, family members with shared access), the User confirms the existence of legal grounds for such processing.
15. Disclaimer of Warranties
- The Service is provided "as is" and "as available" to the maximum extent permitted by law.
- The Provider does not guarantee that the Service will work without errors and interruptions, and does not guarantee that the User will achieve any financial results.
- Information, reports and recommendations (including AI results) are for reference only and do not replace professional advice.
16. Limitation of Liability
- To the maximum extent permitted by law, the Provider is not liable for indirect, incidental, special, punitive or consequential damages, including lost profits, data loss or business reputation.
- The Provider's aggregate liability for any claims related to the Service is limited to the amount actually paid by the User for the Subscription in the last [[3/6/12]] months preceding the event, or [[100 EUR]], if the User has not made payments.
- Nothing in the Terms limits liability that cannot be limited by law (for example, intent, gross negligence, liability for harm to life and health - if applicable).
17. Indemnity
- The User undertakes to indemnify the Provider for losses, expenses and claims of third parties arising from: (a) the User's violation of the Terms; (b) illegal User Content; (c) violation of third-party rights; (d) improper use of the Service.
- The Provider will notify the User of such claim within a reasonable time and provide an opportunity to participate in the defense if legally possible.
18. Term and Termination
- The contract is valid from the moment of acceptance of the Terms until termination of Service use/Account deletion or Subscription expiration, unless otherwise provided.
- The User has the right to stop using the Service and delete the Account in settings or by contacting support.
- The Provider has the right to suspend or terminate access to the Service in case of violation of the Terms, legal requirements, as well as to protect the security of the Service and other users.
- After termination of the contract, the Provider may delete User Content within the timeframes specified in the Privacy Policy, taking into account backups and legal obligations.
19. Force Majeure
The parties are released from liability for non-performance of obligations due to force majeure circumstances, including communication failures, provider accidents, military actions, natural disasters, actions of authorities, etc., provided that the other party is notified within a reasonable time.
20. Governing Law and Dispute Resolution
- The law of [[country/state/jurisdiction]] applies to the Terms.
- Disputes are resolved through negotiations. If an agreement cannot be reached, the dispute is subject to consideration in [[court/arbitration/venue]] in accordance with applicable law.
- If consumer legislation applies to the relationship, mandatory consumer rights are preserved regardless of the chosen jurisdiction.
21. Final Provisions
- If any part of the Terms is found to be invalid, the remaining provisions remain in force.
- The Provider has the right to engage contractors and providers to provide services and support the Service, remaining responsible for the performance of its obligations within the limits established by the Terms.
